Allowance in the event of the death of one of the spouses

  • The indemnity in case of the death of a spouse shall be established if the following conditions are met:

    - at the time of death, the deceased spouse was receiving an old age pension under the provisions of the Law no. 156-XIV of 14.10.1998 on the public pension system less than 5 years after the pension was established;

    - the death occurred as of 01.01.2020;

    - the surviving spouse, regardless of age, had at least 15 years of marriage with the deceased;

    - the indemnity in case of the death of one of the spouses is granted regardless of whether the surviving spouse is a pensioner in the public pension system or not, provided that the surviving spouse's pension in payment or the insured monthly income earned by the surviving spouse in the month of the spouse s death does not exceed 1.5 times the minimum subsistence level for pensioners, according to the data of the National Bureau of Statistics available at the time of applying for the indemnity;

    - the indemnity in case of the death of one of the spouses was claimed within 3 years from the date of death.

The following original and copies of the following documents shall be attached to the application for the allowance in the event of the death of one of the spouses:

- Identity card

- Death certificate

- Marriage certificate

The application for the establishment of the allowance in the event of the death of one of the spouses shall be submitted in person by the surviving spouse, on presentation of confirmatory documents, to the territorial office of social insurance of the surviving spouse's place of residence, where it shall be compulsorily registered.

The allowance is determined from the month of application. If the application is submitted in the month in which the death of the spouse occurred, the allowance is determined from the following month.

Entitlement to the allowance in the event of the death of one of the spouses or rejection of the application shall be granted by a decision issued by the territorial social insurance body and signed by its head within 30 days of the date of submission of the application with all the necessary documents.

The decision on the rejection of the application and the reason for rejection shall be sent to the applicant within 5 days from the date of issue.

The amount of the allowance shall be set at the amount of the retirement pension in payment at the date of the pensioner's death, but may not exceed the amount of five average monthly salaries forecast in the economy for the year in which the death occurred. The forecast average monthly wage for the economy is approved by the Government.

The allowance shall be granted monthly for a period calculated according to the formula:

 

T = 5 - p,

 

where:

          T - the period for which the surviving spouse will receive the allowance;

          p - the period during which the deceased spouse received a retirement pension.

Allowance in the event of the death of one of the spouses is not reviewed or indexed.
